Benue state government has secured an order from a Federal High Court in
Abuja to prevent the Economic and Financial Crimes Commission (EFCC) from investigating into the finances of Benue State Government.
The EFCC recently commenced investigation into an alleged N22 billion fraud involving the spending of security votes by the state government.
However, in an originating summons of the suit marked FHC/MKD/CS/42/18 filed by the Attorney General of Benue State, the state challenged the powers of the EFCC to investigate or inquire into the accounts and /or appropriations, disbursements and administration of the funds of Benue State Government having regard to the clear provisions of sections 1(1) and (3), 125(2),(4) and (6), 128 and 129 of the 1999 constitution.
Justice Nnamdi Dimgba ordered parties “Not to take any further steps so as not to destroy the res, which the subject matter before the court, pending the determination of the originating summons adjourned to August 29, 2018.”
While the Benue State Government was represented by its counsel, Emeka Etiaba (SAN), Slyvanus Tahir appeared for the EFCC.
